1. Acceptance of Terms

1. These Terms of Service (hereinafter "these Terms") set forth the conditions of use for services provided by the provider (hereinafter "we" or "us") of Discover Kyoto (hereinafter "the App").
2. By downloading, installing, or using the App, you agree to all provisions of these Terms.
3. If you do not agree to these Terms, please do not use the App.

2. Description of Service

1. The App is a location-based tourism guide application that uses geofence technology to automatically notify users about temples, shrines, historical spots, and hidden gems within Kyoto city, and provides guide text and audio guides.
2. The main features of the App include:
   • Push notifications triggered by geofence proximity to spots
   • Display of guide text for each spot
   • Audio guide via text-to-speech (TTS)
   • Spot display and route display on maps
   • Walk log (walking record) storage and display
   • Support for 8 languages (English, Japanese, Korean, Traditional Chinese, Simplified Chinese, French, Spanish, Italian)

3. In-App Purchases

1. The App is free to use with advertisements displayed.
2. By purchasing "Deep Content" (paid content), additional spots including alleys, small shrines, and hidden gems are unlocked.
3. Deep Content is priced at ¥1,000 (or the equivalent in your region) as a one-time purchase for permanent access.
4. Purchases are processed through Apple's StoreKit 2 and are associated with your Apple ID.
5. Refunds after purchase are subject to Apple's refund policy.
6. Advertisements will continue to be displayed after purchasing Deep Content.

4. Requirements for Use

1. To use the App, the following requirements must be met:
   • You must own an iPhone running iOS 17 or later
   • Location Services must be enabled (required for geofence functionality)
   • Notifications must be permitted (required for spot proximity notifications)
2. Users are responsible for their own use of the App.

5. Use of Location Data

1. The App requires background location access to provide geofence functionality.
2. Location data is processed only on your device and is never transmitted to external servers.
3. For details on location data usage, please refer to our separate Privacy Policy.

6. Prohibited Activities

Users must not engage in the following activities when using the App:

1. Activities that violate laws or public order
2. Activities related to criminal acts
3. Destroying or interfering with the App's servers or network functions
4. Activities that may disrupt the operation of the App
5. Decompiling, disassembling, or reverse engineering the App
6. Copying, modifying, or adapting the App in whole or in part
7. Unauthorized reproduction or redistribution of the App's content (guide text, spot data, etc.)
8. Any other activities deemed inappropriate by us

7. Intellectual Property

1. All intellectual property rights in the App's guide text, spot data, UI design, and other content belong to us.
2. Images obtained from Wikimedia Commons are subject to their respective license terms.
3. Apple MapKit content is subject to Apple's terms of use.

8. Disclaimer

1. We make no warranties regarding the content, operation, performance, availability, accuracy, completeness, or usefulness of the App.
2. We are not liable for any damages incurred by users through the use of the App, except in cases of our intentional misconduct or gross negligence.
3. We are not responsible for:
   • Historical accuracy of guide text (information is for reference purposes only)
   • Timing or accuracy of geofence notifications
   • GPS accuracy or errors in location data
   • Accidents or injuries arising from the use of the App
   • Battery consumption or data usage
   • Damages caused by force majeure (natural disasters, communication failures, government regulations, etc.)
4. The App is not developed by Apple Inc., and Apple assumes no responsibility for the App.
5. In the event that we are held liable for damages, compensation shall be limited to direct and ordinary damages, with a maximum of ¥1,000.

9. Safety Precautions

• Do not stare at your smartphone screen while walking; always be aware of your surroundings
• Obey traffic rules and avoid using the App on roads or in dangerous areas
• Observe proper etiquette at temples and shrines, and follow any restrictions such as photography bans
• When using the audio guide, keep the volume at a level where you can still hear surrounding sounds

10. Changes, Suspension, and Termination of Service

1. We may change, add, or remove App content without prior notice to users.
2. We may temporarily suspend all or part of the App without prior notice in the following cases:
   • When performing system maintenance, inspection, or repairs
   • When the App cannot be operated due to force majeure such as fire, power outage, or natural disaster
   • When we deem it necessary for other reasons
3. We may terminate the App by providing notice to users.

11. Privacy

1. We handle user information obtained in connection with the use of the App in accordance with our separate Privacy Policy.
2. The Privacy Policy constitutes a part of these Terms.

12. Changes to These Terms

1. We may change these Terms without obtaining user consent in the following cases:
   • When the changes are in the general interest of users
   • When the changes do not conflict with the purpose of the App and are reasonable in light of the necessity of the changes, the appropriateness of the revised content, and other relevant circumstances
2. When changing these Terms, we will post the intended changes, the revised content, and the effective date within the App or on our website a reasonable period before the effective date.

13. Prohibition of Assignment

Users may not assign or pledge their status under these Terms, or any rights or obligations under these Terms, to any third party without our prior written consent.

14. Severability

If any provision of these Terms, or any part thereof, is determined to be invalid or unenforceable under applicable law, the remaining provisions and the remaining portions of any partially invalid or unenforceable provision shall continue in full force and effect.

15. Governing Law and Jurisdiction

1. These Terms shall be governed by the laws of Japan.
2. Any disputes arising between us and users in connection with these Terms or the App shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
